Order Process and Shipping: We will send you an order confirmation e-mail once you complete your purchase. Lywett.com offers shipping in Canada only. We do not currently deliver to P.O. boxes, international addresses, and to a few limited geographic areas within Canada.
When is Your Credit Card Charged: Your credit card will be charged once the product or service you purchased has been shipped. When more than one item is requested on your order, we will charge your card for each item as it ships. Since shipping times vary by item, your credit card statement may reflect individual charges for each item as they are shipped. Before your credit card is charged, an authorization will be obtained for the amount of your order. For items with extended shipping time, your credit card may be re-authorized and funds will continue to be set aside (by your bank) for the remaining balance of your order – until Lywett.com charges your card upon shipment of the item. All credit cards must be valid, authentic and you must be authorized to use them. If the charge is not authorized or accepted, we reserve the right to cancel your order without notice and with no further liability or obligation to you. We reserve the right to stop accepting credit cards from one or more issuers at any time.
Guarantee, Returns and Exchanges: Lywett guarantees your satisfaction with the merchandise you purchase from us. Lywett.com merchandise may, subject to what follows regarding diamonds and certain electronic products, be returned by contacting us at email@example.com. When returning items containing a 1.00 ct diamond or larger, Lywett may require additional time to verify the diamond, in which case a refund will be approved upon positive verification. This process may require 2 to 5 business days. Televisions, projectors, computers, cameras, camcorders, iPOD / MP3 players and cellular phones must be returned within 90 days of purchase to qualify for a refund. Return/refund details are available on every products description page in detail. Lywett may in the future restrict its return policy regarding other products. Restrictions will be shown on the corresponding product description page.
Order Changes or Cancellations: Your orders are processed electronically. We cannot make changes to the “ship to” address once an order has been placed. Once a product is released to the delivery agent, you will receive a shipping confirmation e-mail with updated tracking information (if available) including an estimated date of delivery. Orders cannot be cancelled or changed through the Site if merchandise has already been shipped. If you need to change or cancel an order after your order has been shipped, contact us at firstname.lastname@example.org.
Modification of Terms: Lywett reserves the right to modify these Terms in our sole discretion from time to time and only Lywett has the right to do so. If the Terms are changed, we will post the new Terms on the Site and note the date they were last updated. Any changes or modifications will be effective upon posting of the Terms as revised, and your purchase of products or services on the Site following the posting will constitute your acceptance of the new Terms.
Changes, Misprints and Errors: Subject to applicable law, we: (a) reserve the right to change the products and services advertised or offered for sale through the Site, the prices or specifications of such products and services and any promotional offers at any time and from time to time without any notice or liability to you or any other person; (b) cannot guarantee that products or services advertised or offered for sale on the Site will be available when ordered or thereafter; (c) reserve the right to limit quantities sold or made available for sale; (d) do not warrant that the Site or any material that appears on the Site is accurate, complete, reliable, current or error-free; (e) reserve the right to cancel, to terminate or not to process orders (including accepted orders) where the price or other material information on this site is inaccurate; and (f) reserve the right to cancel an order if there is not enough inventory of an item to complete your order (or if an item is no longer available). If we do not process an order for such reason(s), we will advise you that the order has been cancelled and will either not charge you or will apply a credit to the payment type used in the order. Some jurisdictions may not allow the exclusions and disclaimers of certain implied warranties, so some of the provisions of this section may not apply to you.
Your Information and our Privacy Statement: We rely on the information you give us to provide you with the products and services you order from the Site. You agree that: (a) all information you provide to us, including your name, address, shipping address, credit card number(s) and expiration date(s) will be current, accurate and complete; and (b) you are solely responsible for any loss, damage, costs or claims that you, we or any other person may suffer or incur as a result of your failure to provide current, accurate and complete information. Lywett may collect, use and disclose your personal information in accordance with our Privacy Statement or as otherwise required or permitted by law.
Applicable Law, Venue and Limitation of Actions: This section does not apply in the Province of Québec. These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario applicable to agreements made and entirely to be performed within the Province of Ontario, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws. Regardless of where you access this site, you agree that any action at law or in equity arising out of or relating to these Terms shall be filed and adjudicated only in the federal or provincial courts located in Ontario (Judicial District of Ottawa), and you hereby irrevocably and unconditionally consent and attorn to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of these Terms.
UPS Standard delivery: UPS standard delivery provides a door* delivery. This service does not include set up or assembly of items or removal of packaging materials.
1. Once the items ships, you will receive a ship confirmation email with tracking information. Please visit the carrier’s Website for more information on your delivery.
2. Your UPS delivery cannot be scheduled to arrive at a specific time. UPS Standard deliveries are delivered between 9:00 a.m. and 7:00 p.m, Monday through Friday. Delivery hours may be extended during peak holiday times.
3. If UPS attempts to deliver an order and there is no one home, the driver may do a Driver Release and leave the shipment for you unless a signature is required. It is up to the discretion of the driver to leave it at the door or not. If the driver does not leave the order, then they will leave an InfoNotice.
4. UPS will make 3 attempts to deliver the package. If they are unsuccessful after 3 attempts, the package will be returned to the shipper.
* Door delivery with the exception of some remote communities where the package may be held for pick up.
Severability: If any provision of the Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of these Terms and shall not affect the validity and enforceability of any remaining provisions.
Language The parties hereto acknowledge having expressly required that the Terms are to be drawn up in the English language.
